hereinafter called the MEMBER, and Corn Belt Energy Corporation, hereinafter called the SELLER, shall become effective on the date of SELLER acceptance. The SELLER shall supply and/or install the surge protection device(s) and related materials specified below in accordance with the terms and conditions set forth.

a) One (1) low profile meter-mounted whole-house surge protector device @ $175.00
b) One (1) 400 Amp low-profile meter-mounted whole-house surge protector device @ $250.00

The MEMBER’S home must be properly grounded according to the National Electric Code for any warranties to be honored. Corn Belt Energy Corporation will perform this service if the MEMBER so desires. The cost will depend on individual circumstances.

Under payment option (b), if the property on which the device(s) has been installed is sold, or if the name changes on the account to which the device(s) is billed, the SELLER may demand full payment of the remaining balance from the MEMBER without further notice. In addition, if any payment required hereon by the MEMBER is not made by the delinquent date indicated on the electric bill, then the entire remaining balance for the device(s) shall immediately without notice become due at the option of the SELLER. Failure to exercise this option by the SELLER shall not constitute a waiver of the right to do so at a later date in the event of another default or to terminate electric service due to non-payment. If it is necessary to place this agreement in the hands of an attorney for enforcement of any of its terms and conditions, the MEMBER agrees to pay reasonable attorney fees and all costs thereby incurred.

The SELLER reserves the right to cancel this agreement for any reason or for no reason.

The SELLER shall install said EQUIPMENT within a reasonable amount of time after this agreement is returned by the MEMBER. In the event this agreement is not accepted by the SELLER, the MEMBER will be notified as to cause and can reapply, provided acceptance can then be extended.

The SELLER makes no warranties of any kind to the MEMBER with regard to the equipment sold.

The MEMBER understands that the whole-house surge protection device:

a) is covered solely by the manufacturer’s 15 year warranty, and that the SELLER makes no warranty including fitness for particular purpose.
b) contains no user serviceable parts and requires no maintenance or resetting.
c) is an integral part of the electric meter, and agrees that it can be removed only by SELLER employees.
d) will not protect against direct or indirect high-energy lightning strikes beyond the manufacturer’s rated energy absorption level, and agrees that the SELLER is not responsible for any damage from weather- or lightning-related incidents to any property owned by the MEMBER.
e) will not provide adequate protection to highly sensitive electronic equipment.
f) is strictly a power line surge suppressor and as such will not protect the structure, telephone line, cable TV line, antennae, or people against direct lightning strikes of any kind.

If the surge protection device should become defective during the manufacturer’s warranty period, the SELLER will assist the MEMBER in obtaining a replacement unit from the manufacturer and will install it at no cost. Any removal request received by the SELLER from the MEMBER, except for the above warranty related action, will require a service charge of $10.00.
